More information about the afternoon panel on RED FLAG LAWS:

States across the nation are passing legislation creating Extreme Risk Protection Orders, also known as “RED FLAG LAWS.” These laws allow law enforcement officers and others to seek a court order to seize the owner’s firearms if there is a credible threat that the owner may cause harm to himself or others.

The initial hearing is conducted without notice to the firearm owner and without the owner’s presence. Only after that hearing and resulting decision does the owner have the opportunity to appear in court to defend himself and potentially regain his firearms.

RED FLAG LAWS are an issue of growing importance in the area of Second Amendment law. This panel is intended to provide a discussion of the benefits or problems presented by RED FLAG LAWS in both legal and policy realms.

Panelists:

  • Alexandra Garza – State Director, NRA-Institute for Legislative Action
  • David B. Kopel – Research Director, Independence Institute
  • Cody Wisniewski – Attorney, Mountain States Legal Foundation
