Denver, Colorado — June 23, 2021 — Mountain States Legal Foundation cheered today’s 6-3 Supreme Court decision upholding property rights in the so-called Cedar Point Nursery case, which challenged a California law requiring businesses to open their property to union organizers without compensating those businesses for the use of their property. MSLF filed numerous amicus curiae briefs in support of the Nursery.
David McDonald, MSLF’s lead attorney on the case, issued the following statement in response to the ruling:
“Congratulations and well done to our friends with the Pacific Legal Foundation for their hard work making this decision a reality! The Court struck a blow for liberty today, enforcing meaningful restrictions on the government’s ability to invade private property with a forcefulness and clarity we rarely see from the Court on property rights issues. The decision today in Cedar Point is a major win for small businesses, private property owners, and all Americans who benefit from a limited government and the rule of law.”
