This week our Nashville, Tennessee based attorney, Kaitlyn Schiraldi, filed a comment on behalf of the Goldwater Institute, urging the Tennessee Supreme Court to change part of its licensing rules that govern lawyers. The licensing rule in question requires applicants from other states to have practiced full-time for five of the seven prior years before they can waive in to Tennessee’s bar. This rule disproportionately harms women, many of whom are the primary caretakers of their household on top of working in the demanding practice of law. That’s not to say women are the only ones harmed by this rule. Taking care of an elderly parent or a sick relative knows no gender and may require part-time work. This comment notifies the Tennessee Supreme Court of the barriers it has erected around the state despite the recently enacted Right to Earn a Living Act. Commenting on this arbitrary rule aligns with Mountain States’ mission to untangle the American people from government overreach and arbitrary decision making.
