MSLF Victory Against Biden Administration’s Title IX Regulations

MOUNTAIN STATES LEGAL FOUNDATION SECURES FINAL VICTORY AGAINST BIDEN ADMINISTRATIONS TITLE IX REGULATIONS

Federal government’s attempt to redefine sex discrimination and compel speech in schools defeated 

LAKEWOOD, Colo. (June 11, 2026)—Mountain States Legal Foundation (MSLF) is celebrating a major victory for free speech and constitutional government after the Biden Administration’s controversial Title IX regulations were officially defeated following nearly two years of litigation. 

MSLF represented Moms for Liberty in a challenge to the U.S. Department of Education’s April 2024 Title IX rule, which sought to dramatically expand the meaning of sex discrimination under federal law. Among other changes, the regulations attempted to classify “misgendering” and “deadnaming” as unlawful discrimination, effectively pressuring schools, educators, students, and parents to parrot the federal government’s preferred language and views regarding gender identity. 

MSLF argued that the Department of Education lacked the authority to rewrite federal law and that the regulations violated constitutional protections for free speech by compelling individuals to communicate messages contrary to their beliefs. 

Senior Attorney for Mountain States Legal Foundation, James Kerwin, said, “Our victory sends a clear message that government cannot compel Americans to mouth adherence to fashionable ideologies on sex and gender under the guise of anti-discrimination law.  This is a big win for free speech and the Constitution.” 

In June 2024, MSLF secured a preliminary injunction preventing enforcement of the regulations against its clients. As litigation continued, federal courts in Texas and Kentucky ruled that the Department of Education had exceeded its statutory authority and struck down the regulations nationwide. 

With the conclusion of the remaining appeals, the challenged regulations have now been permanently defeated. 

The victory marks a significant rebuke of government overreach and preserves the rights of students, parents, educators, and schools to engage in constitutionally protected speech without fear of federal punishment.
