After nearly two years of litigation, the Biden Administration’s controversial Title IX regulations are officially defeated, and with them, a dangerous attempt to redefine federal law and compel speech in America’s schools.
Mountain States Legal Foundation proudly represented Moms for Liberty in a challenge to the Department of Education’s April 2024 Title IX rule. Among other sweeping changes, the regulations sought to force schools to treat so-called “misgendering” and “deadnaming” as unlawful sex discrimination under federal law.
In practical terms, the federal government was attempting to pressure schools, teachers, students, and parents into adopting the government’s preferred language and views on gender…or risk federal consequences.
We argued that the government has no authority to compel Americans to speak against their conscience or punish them for acknowledging biological reality.
In the summer of 2024, we secured a preliminary injunction blocking enforcement of the rule. Meanwhile, federal courts in Texas and Kentucky struck down the regulations entirely.
Now, the final appeals have come to an end, and the regulations are gone.
This victory safeguards one of our most fundamental constitutional freedoms: the right to speak truthfully without fear of government punishment. It sends a powerful message that federal agencies cannot simply rewrite the law to impose ideological mandates on the American people.
