LAKEWOOD, Colo. (August 12, 2026) — Mountain States Legal Foundation (MSLF) and its Center to Keep and Bear Arms (CKBA) has filed a motion for a preliminary injunction asking a federal court to halt Colorado’s new permit-to-purchase requirements for certain semiautomatic firearms while its constitutional challenge proceeds.
The law, enacted through Senate Bill 25-003 and effective August 1, requires Coloradans seeking to purchase covered firearms to navigate a burdensome, confusing multi-step process involving background checks, government approvals, mandatory training, testing, and fees.
In Del Toro v. Polis, MSLF argues that Colorado’s permitting scheme violates the Second Amendment by placing substantial barriers between law-abiding citizens and their constitutionally protected and natural right to acquire firearms. The Tenth Circuit has recognized that the Second Amendment’s protection of the right to keep and bear arms necessarily includes the right to acquire them.
The motion points to the law’s practical consequences, including counties where applicants may have difficulty finding required training and a process that can involve hundreds of dollars in fees and multiple layers of state and local bureaucracy.
MSLF is asking the U.S. District Court for the District of Colorado to enjoin enforcement of the permit-to-purchase provisions while the case proceeds.
