MSLF Moves to Defend Idaho Ranchers from Federal Water Grab

Today, Mountain States Legal Foundation (MSLF) filed a motion to intervene in the ongoing case of United States v. Idaho. Representing four clients—the ranches of Paul Nettleton, Tim Lowry, and Don Pickett, as well as the Idaho Farm Bureau Federation—we seek to intervene as a defendant in the federal government’s lawsuit against the state of Idaho, and ultimately persuade the court to dismiss. If successful in the motion, we will argue that under the United States Supreme Court’s ruling in US v. New Mexico (1978) and the Idaho Supreme Court’s decision in Joyce v. US (2007), Idaho is within its authority to declare the federal government’s rights forfeited under state law.
