Today, Mountain States Legal Foundation (MSLF) filed a motion to intervene in the ongoing case of United States v. Idaho. Representing four clientsâthe ranches of Paul Nettleton, Tim Lowry, and Don Pickett, as well as the Idaho Farm Bureau Federationâwe seek to intervene as a defendant in the federal governmentâs lawsuit against the state of Idaho, and ultimately persuade the court to dismiss. If successful in the motion, we will argue that under the United States Supreme Courtâs ruling in US v. New Mexico (1978) and the Idaho Supreme Courtâs decision in Joyce v. US(2007), Idaho is within its authority to declare the federal governmentâs rights forfeited under state law.
