Mountain States Legal Foundation Attorney Cody Wisniewski today offered these comments in response to a grizzly bear-related ruling by the 9th Circuit Court of Appeals.
“It is heartening to see the Ninth Circuit recognize the accomplishments of the grizzly bear recovery effort – specifically noting the successful recovery of the Yellowstone area species,” said Wisniewski . “While the Ninth Circuit upheld the district court’s opinion, the Circuit clarified that the analysis the Fish and Wildlife Service willingly began after the district court’s order is very limited in scope. MSLF and our clients will continue, however, to fight to ensure that agencies are not required to engage in judicially-created analyses that are not mandated by the ESA. We are currently evaluating our next steps with respect to this specific matter.”
