In a major potential setback for President Biden’s plan to grant farmers and ranchers loan relief based solely on the color of their skin, a federal judge in Wisconsin on Thursday ordered a halt to such disbursements while the constitutionality of such race-based payments is being adjudicated. Mountain States Legal Foundation and the Southeastern Liberty Foundation jointly represent a Wyoming rancher and Tennessee farmer who are challenging the legality of the program. In the meantime, other public interest firms also continue the same fight in other venues. MSLF’s lead attorney on the case, Will Trachman, released the following statement today in response to the ruling:

“Congratulations to the Wisconsin Institute for Law and Liberty (WILL) for achieving a significant victory on their motion for a Temporary Restraining Order to stop this discriminatory program while their case can be heard. We hope the Biden Administration understands that it can’t separate Americans by racial groups and treat them differently on that basis.”
