LAKEWOOD, Colo. (October 4, 2024) — In a move that could reshape the future of the firearms industry and the Second Amendment, the Supreme Court has agreed to hear the case of Smith & Wesson v. Estados Unidos Mexicanos. This case arose when the Mexican government filed suit against Smith & Wesson and several other American firearms manufactures, alleging that they had intentionally “flooded” Mexico with firearms that were subsequently used by the country’s violent drug cartels to commit crime. Mexico is seeking $10 billion dollars in damages.
This is a clear case of foreign interference in United States affairs by a foreign government, and a not so veiled attempt to undermine Americans’ right to keep and bear by economically destroying the United States firearms industry. Mountain States Legal Foundation & Buckeye Institute filed an amicus brief in support of certiorari for this landmark battle to defend the constitutional rights of Americans. Mountain States is thrilled that the Supreme Court has decided to hear this pivotal case that puts the ability of Americans to acquire the means to defend themselves at risk. The Supreme Court has the opportunity to protect the Second Amendment from the legal attacks of Mexico who refuses to accept responsibility for its own cartel problems.
