MSLF Senior Attorney Tyler Martinez made the following comment today in response to oral arguments in Americans for Prosperity v. California which seemed to reflect a good deal of skepticism among the justices about California’s longstanding quest to obliterate donor privacy protections, which was once spearheaded by Vice President Kamala Harris:
“In the Americans for Prosperity case, the Supreme Court will determine if California’s government can warehouse vast amounts of donor information without any particular law enforcement need,” explained Martinez. “In today’s oral argument, the justices seemed split on whether the whole law needed to be tossed out, or if Americans for Prosperity has shown that its donors are uniquely vulnerable to threats and harassment if disclosed. It seems like there is a majority on the Court willing to strike down California’s demand, but the reasoning the Court uses in its opinion will matter just as much as the ultimate outcome.”
